Lie #1:
Day fabricated a quote from the Washington Post. He didn’t just distort a quote—he made one up from scratch. (Source: Day direct mail, “Illegal Immigration”)

Fact:
The Day for Delegate campaign released a direct mail piece during the week of September 24, 2007 that contained the following quote, attributed to the Washington Post:

Under Scott Lingamfelter’s watch, the number of illegal
immigrants in Virginia is now more than 180,000 (Washington
Post, January 25, 2006).

The aforementioned article, “Va. Bills Targeting Illegal Immigrants,” ran on B08 on 1/25/06 and was written by Chris L. Jenkins. Lingamfelter’s name wasn’t even mentioned in the article. Nor was the three term delegate who served 28 years in the United States Army blamed for the explosion of illegal aliens in the Commonwealth.

The quote forged by the Day Campaign appears nowhere in the article. Instead, the article only states that “Studies estimate that Virginia’s illegal immigrant population has tripled since 1996 to about 180,000.” The actual subject of the article was Republican House and Senate members who were standing up to General Assembly Democrats by introducing over 40 pieces of legislation aimed at combating the illegal immigration crisis.

Lie #2
Claimed that Scott Lingamfelter “negotiated with Dominion Power on building new power lines and was a deciding vote on raising utility rates.” (Source: Day direct mail, “Looking for Leadership on Energy”)

Facts:
Scott Lingamfelter voted “yes” during the very first vote on HB 3068. The bill passed by a vote of 85-13—hardly a margin in which one member can be a “deciding vote.” (Source: Legislative Information System)

Lingamfelter voted against the same bill on 2-22-07 and twice on 4-4-07 during the veto session. (Source: Virginia League Information System, LIS)

Lie #3
Day says that he is a "partner with Governor Kaine on energy." (Source: Day direct mail, “Looking for Leadership on Energy”)

Fact:
The only reason Day knew that the state had an energy plan was because Delegate Lingamfelter handed him a copy of the plan at the last forum.

Lie #4
“Bill is an avid hunter…” (Source: Day direct mail, “Father, Neighbor” mailing)

Facts:
Day is not, or has never been a member of the NRA while residing in Virginia. According to the Virginia Department of Game and Inland Fisheries, Day has not held a hunting license in Virginia in the last year and a half, nor does he hold a lifetime hunting license in Virginia.

Lie #5
“ …Bill went on to successfully build and manage four different multi-million dollar businesses before becoming a licensed counselor.” (Source: Day for Delegate direct mail, Father, Neighbor” mailing)

“Day provides psychotherapy to individuals and couples and one of his concerns is improving mental health across the state.” (Source: Potomac News, May 3, 2007)

“’I thought about it, but that was it,’ said Day, a part-time psychotherapist.” (Source: Fauquier Times Democrat, March 21, 2007)

“The professional counselor outlined three key issues…” (Source: Fauquier Times Democrat, July 11, 2007)

“…Bill currently resides in Fauquier County just outside of Warrenton where he works as a licensed counselor.” (Source: www.dayfordelegate.org)

Facts:
Day, who is listed on the staff list at the Fauquier Counseling Center (as of 10:30am on 10/09/07), does not currently have a counseling license or a small business license which would enable him to work at the Fauquier Counseling Center as an independent contractor.

The Virginia State Corporation Commission also has no record of Day’s “WSD Partnership” or “RSY Partnership,” both of which were reported in his amended Statement of Financial Interest. This document was filed with the Clerk of the House of Delegates.

Lie #6
Bill is an environmental activist (source: newspaper interviews, meeting with the Delegate, Day direct mail)

“Bill actively works on energy and quality of life issues with local Fauquier groups such as the
Sierra Club, League of Conservation Voters, Habitat for Humanity, Project Mend-a-House,
and the Piedmont Environmental Council.” (source: Day direct mail)

Bill “is tired of seeing special interests and partisan politics take priority…” (source: Day
direct mail)

Bill will focus on “renewable and alternative energy use…” (source: Day direct mail)

Facts:
According to an amended Statement of Organization, filed with Bruce Jamerson, Clerk of the House of Delegates, Mr. Day profits from substantial oil royalties from Exxon Mobil, Hunt Oil, Pioneer, Chevron, and Texaco.

Former Vice President and author of The Assault on Reason Al Gore calls Exxon Mobil the worst corporate contributor the world’s global warming problem:

"ExxonMobil has been particularly influential with the current administration and has been more active than any other polluter in its brazen efforts to try to manage public perceptions of the reality and seriousness of the climate change crisis." Page 201, The Assault on Reason by Al Gore (2007)

Lie #7
Accused Delegate Lingamfelter, a 28 year combat veteran, retired Colonel, and decorated combat veteran of opposing a life insurance assistance bill for National Guard families.

Facts:
The referenced vote was not on a bill at all, but an obscure budget amendment in the 2005 session that Delegate Lingamfelter in fact voted in favor of. He was also recognized by the Virginia Sheriff’s Association for his work to pass the amendment, which also included a well-deserved salary boost for law enforcement personnel.
